The impact of the Family and Medical Leave Act on employers is an important and timely issue. Since the law’s enactment in 1993, rising numbers of employees have taken advantage of its provisions.The share of employees using FMLA leave climbed from an estimated 3.6% in 1995 to 6.5% in 2000.
In our survey, employers reported that 8.9% of workers, on average, used FMLA leave in the previous year (2006). FMLA leave usage is likely to escalate further due to growing employee familiarity with the law and the increasing incidence of serious health problems accompanying the demographic shift toward an aging U.S.population. This steady upward spiral provides an obvious impetus for exploring employers’ experiences and attitudes with respect to the law. The fact that the Department of Labor recently launched a review of the current FMLA regulations contributes added relevance to the issues explored in our report.
